Chubb subsidiary ACE American Insurance Company will introduce new endorsements to its Allied Healthcare Human Services Program in the tail end of the 2nd quarter of 2021. ACE American will introduce two new endorsements to its playbook in California, with a tentative effective date of June 4, 2021, for new and renewal business. Both new endorsements will be exclusionary in nature and are named as follows:
- Access, Collection, Release Or Disclosure Of Confidential Or Personal Information And Electronic Data Liability Exclusion – Bodily Injury and HIPAA Investigation Or Proceeding Exception
- Access, Collection, Release Or Disclosure Of Confidential Or Personal Information And Electronic Data Liability Exclusion
These endorsements will have no impact on written premium as is, but will serve to limit or prevent claims or liability exposure related to confidential or personal data, likely opening the door for future endorsements or programs that will cover such risks. Expect Chubb to continue offering similar exclusions, as the carrier has doubled down since late-2020 on exclusions intended to limit exposure.
Likewise, Church Mutual Insurance Company, S.I., will introduce several exclusions to its playbook in the coming weeks, tentatively scheduled to go into effect in Rhode Island on May 1, if granted regulatory approval. These endorsements are specifically aimed at limiting exposure related to the COVID-19 pandemic, and as such, will introduce communicable disease exclusions. The carrier will introduce four such offerings, with variants Senior Living Professional Liability and Allied Healthcare.
These endorsement variants will target either specified communicable diseases or a named or declare pandemic or epidemic, signaling that Church is aiming to futureproof is coverage against any potential outbreaks that could occur in the future. These endorsements will initially be optional but watch for carriers to push for mandatory exclusions where state regulators allow, which will vary wildly across state lines.
